Second: If you answer "yes" to all of these questions, then your business can begin the journey to becoming a franchise. Your first steps will be to trademark your name and intellectual property, create a business plan entailing expected costs, write an franchise operations manual, and set your franchise fees and royalty rates.

The final and most important step: Prepare the federally required Uniform Franchise Disclosure Document (UFDD - known commonly as the UFOC prior to July of 2008). The UFDD is a complex legal document that must be drafted by a lawyer specializing in franchising. Any potential franchisee must receive this document prior to signing onto your franchise team.  When contracts are completed and signed,  your small business will now have its first official franchise.
